Guangdong, HK and Macau reached consensus to protect IP rights in January

2010年3月24日，国务院颁布了修改后的《中华人民共和国知识产权海关保护条例》（以下简称《条例》）。《条例》修改后，有关条文顺序作了相应调整。为方便知识产权权利人向海关总署申请提供知识产权海关保护总担保，现就有关事项公告如下：
1.海关总署2006年第31号公告及其附件所引用的原《条例》第二十九条，即指现行《条例》第二十八条
2.自2011年2月1日起，知识产权权利人向海关总署申请提交知识产权海关保护总担保，应当使用修改后的《总担保保函（格式）》
特此公告。

本月11日，为深入开展打击跨境侵犯知识产权和制售假冒伪劣商品专项行动，进一步加强粤港澳海关保护知识产权合作，“粤港澳海关加强知识产权保护合作协调会”在广东中山举行，三方就开展“粤港澳海关保护知识产权专项行动”和建立知识产权执法合作长效机制事宜进行了商议研究。海关总署广东分署、香港海关、澳门海关均派员参会。
粤港澳三地海关商定将从1月15日起联手开展代号为“海龙”的打击粤港澳侵权货物跨境运输的专项行动，以进一步打击粤港澳三地跨境侵权违法活动，营造公平、有序的进出口环境。
海关广东分署法规处负责人梁润超透露，该行动为期三个月，期间粤港澳海关设立专职联络员和热线联系渠道，密切开展情报和信息交流，将有针对性地组织海运、陆运、寄递和旅检渠道的保护知识产权的双边联合执法行动，提供包括案件信息协查在内的执法协助，组织开展执法技术交流等活动。
三地海关表示，希望通过举行专项行动，进一步遏制粤港澳跨境侵权违法活动，打掉一批在三地跨区域、有组织地从事进出口侵权活动的集团，同时为加强粤港澳海关保护知识产权合作机制建设，推动三地海关合作的深入发展做出有益尝试。
在国家开展打击侵犯知识产权和制售假冒伪劣商品专项行动期间，海关总署广东分署和广东省内海关除加强与港澳海关的合作外，还进一步加大了侵权案件的查处力度，深入推进与各部门的执法合作。如2010年10月至12月间，广东省内海关共查获侵权嫌疑货物1511.85万件，案值逾2217.9万元人民币，查处了出口假冒“adidas”商标标识案、出口假冒“黑人”牙膏案和出口假冒“REGAL”香烟案等大案要案多起。
海关总署广东分署副主任陈建文表示，今后广东省内海关将以开展专项行动为契机，进一步完善案件查处机制，加强对侵权货物进出口活动态势的分析，强化风险分析和布控、推进与包括港澳海关和广东省内其他知识产权执法部门在内的执法合作，以更有效地打击广东关区进出口侵权活动，进一步营造公平、有序的进出口环境。
March 24, 2010, the State Council promulgated the revised "Regulations on Customs Protection of Intellectual Property Rights" (hereinafter referred to as "Regulations"). After the revision of "Regulations", the order has been adjusted accordingly. To facilitate the application by the intellectual property owners for the total IPR customs protection guarantee provided by the Customs Department, the related matters are announced as follows:
1.The original article 29 of “Regulations” referenced by Customs Announcement No. 31 of 2006 and its annexes is referring to the existing Article 28 of "Regulations"
2. Since February 1, 2011, the intellectual property owners shall use the revised “general security guarantee (format) to submit to Customs Department for the general guarantee of IPR customs protection.

On January 11, to fight against cross-border infringements of intellectual property and selling counterfeit and shoddy goods, and further strengthen cooperation among Guangdong, Hong Kong and Macau Customs, "The meeting of Guangdong, Hong Kong and Macau Customs to strengthen IPR protection cooperation and coordination” was held in ZHONGSHAN, Guangdong, The three parties discussed carrying out the" special action of Guangdong, Hong Kong and Macau Customs IPR "and the establishment of long-term mechanism for IPR enforcement cooperation. General Administration of Customs Guangdong Branch, Hong Kong Customs and the representatives from the Macao Customs all attend the meeting.
The 3 Customs agreed to carry out the special action code-named "Dragon" to combat cross-border transportation of goods infringing IP rights since January 15 to further crack down illegal cross-border activities in Guangdong, Hong Kong and Macau, therefore to create a healthy import and export environment.
According to the head of Guangdong branch of Customs regulations Liang Run Chao, the duration of this action is three months, the Customs hotline channel will be set with full-time liaison closely to carry out intelligence and information exchange, and the actions of bilateral legal protection of intellectual property will be targeted to organize shipping, land transportation, delivery and travel check the channel, providing the legal assistance for the wanted information, including an investigation of the case and organizing technical activities exchange of law enforcement.
The 3 Customs expressed the hope that by taking the special actions the illegal activities and cross-border infringements would be further curbed, destroying the organized groups engaged in cross-regional import and export of infringing activities, meanwhile strengthening protection of intellectual property cooperation mechanisms to promote the development of customs cooperation in Guangdong, Hong Kong and Macau Customs.
During the national campaign against IPR infringement and selling counterfeit and shoddy goods, The Guangdong Branch of General Administration of Customs and the customs in Guangdong province in addition to cooperate with Hong Kong and Macau Customs, made more efforts to investigate cases of infringement to further promote the cooperation of every departments of law enforcement. Such as Guangdong Customs has seized the 15,118,500 suspected infringing goods amounting to more than 22.179 million Yuan, finding out the export of counterfeit "ADIDAS" trademark, and the export of fake "black" toothpaste and the fake "REGAL" cigarettes during the 2010 October and December.
Deputy director of the Guangdong Sub-Administration of Customs Chen-JIAN-WEN said, in the future, Guangdong Customs will carry out special operations as an opportunity to further improve case investigation mechanism, strengthen the analysis of import and export of infringing goods, risk analysis and surveillance, promote the cooperation of Guangdong Province, Hong Kong and Macau Customs and other intellectual property rights enforcement agencies, effectively fighting against infringements activities in Guangdong area, and further create a fair and healthy import and export environment.
